Iran’s Council of Ministers, acting on a proposal from the Ministry of Justice and pursuant to Article 138 of the Constitution, has approved an amendment to Clauses 2 and 5 of Cabinet Resolution No. 141554/T65422H dated 1404/9/1, which concerns using the capacity of border and selected provinces to supply essential goods needed by the country and regulate the domestic market.
Under the amended Clause 2, barter of Iranian export goods for essential goods is permitted according to the resolution’s procedures, and their import is considered to satisfy the exporter’s currency repatriation obligation. A note to the clause sets the currency needed for this purpose at up to 300 million dollars, drawing on Note 7 of Article 5 of the executive bylaw for the Law on Export and Import Regulations (as amended 1404/2/10), with the Ministry of Agricultural Jihad required to immediately confirm requests received from border provincial governorates within the relevant commodity-policy framework through the applicable system. A second note exempts importers of goods covered by the resolution from the ceiling and track-record restrictions otherwise applicable to importer registration; the currency repatriation obligation of both the exporting and importing party using the barter method to settle currency is conditioned on the definitive clearance and entry of the essential goods through customs. A third note limits the resolution’s coverage to all export goods except petrochemical products, refined products, steel, and non-ferrous base metals and petroleum products, with the Working Group on Return of Export Currency Proceeds to decide on exceptions to this exclusion.
The amended Clause 5 sets a maximum of five days, coordinated with border governors, for completion of customs clearance formalities (standard, health and quarantine permits) for the import of essential goods under the resolution. A note further exempts requirements for CIQ and IRC certificates for applicants importing goods covered by the resolution, applying to trade categories including kolbari, border-resident trade, “pileh-vari” and formal trade, and instead bases clearance on the completion of standard testing, health confirmation (Food and Drug Deputy of the Ministry of Health, Treatment and Medical Education) and any required testing, including animal and plant quarantine for genetically modified inputs used solely for livestock feed.
The amendment was communicated by the Ministry of Industry, Mine and Trade’s Office of Export and Import Regulations to Iran Customs for implementation, with copies sent to the Central Bank of Iran, the National Standards Organization of Iran, and other relevant ministries and organizations for coordination.
