Cabinet Amends Import-Export Regulations Bylaw

The Cabinet of Ministers has approved amendments to the executive bylaw of the Import and Export Regulations Law (Resolution No. 1395/T16H of 1994 and its subsequent amendments), covering committee composition, quota controls in the Comprehensive Trade System, and export ring certification for select commodities.

Effective from
20 May 2025

No. 5224585

The Cabinet of Ministers, at its session on the proposal of the Ministry of Industry, Mine and Trade, the Plan and Budget Organization, and the Central Bank of the Islamic Republic of Iran, and pursuant to Article 138 of the Constitution, approved amendments to the executive bylaw of the Import and Export Regulations Law (originally issued under Resolution No. 1395/T16H dated April 26, 1994, and its subsequent amendments). The Ministry of Industry, Mine and Trade communicated the resolution to the Islamic Republic of Iran Customs Administration for implementation.

The amendments include: adding the Ministry of Health, Treatment and Medical Education alongside the Ministry of Agricultural Jihad in Article 1; revising the committee referenced in the note to Article 4 so that it is chaired by the Director General of the Trade Promotion Organization of Iran and composed of duly authorized representatives nominated by member agencies, with provision for a representative from the relevant unit at the Ministry of Industry, Mine and Trade to attend without voting rights on industry-related proposals; extending, in the note to Article 5, a previously three-month deadline to the end of 1404; and revising the note to Article 6 so that annual quota ceilings for different goods and importers, set by the relevant minister for each ministry, are applied and monitored systematically through the Comprehensive Trade System, with no possibility of issuing order registrations or statistical entries beyond the quota — while imports funded from the National Iranian Oil Company’s and its subsidiaries’ statutory share of crude oil and gas condensate export proceeds, from an executive agency’s dedicated resources approved by the relevant working group, from importers’ own foreign-currency deposits (and those of others, with proven currency origin through the banking network), and from resources under Article 38 of the bylaw remain outside these quota ceilings.

The amendments also add, at the end of clause (b) of Article 8, a requirement that export of goods designated by the Ministry of Industry, Mine and Trade — intended to create transparency in the value of homogeneous raw materials tradable on the commodity exchange and to prevent unfair competition among exporters and loss of export markets — take place only upon presentation of a trading certificate from the commodity exchange’s export ring. Further changes renumber and relocate provisions within clause (10) of Article 10 and revise cross-references in Article 12, and add a new clause (10) to Article 38 naming the Ministry of Foreign Affairs, the Ministry of Health, Treatment and Medical Education, and affiliated organizations, universities of medical sciences, and health and treatment service providers.
