The Ministry of Health, Treatment and Medical Education has instructed the Islamic Republic of Iran Customs Administration on how to implement a ruling of the General Board of the Administrative Justice Court that voided the blanket application of Article 4 of the executive bylaw for the Law on Strengthening and Developing the Standard System (the bylaw approved under Cabinet Resolution No. 131089/T55525H dated October 1, 2019).

The Deputy Minister and President of the Food and Drug Organization had earlier informed customs that, per the ruling and pursuant to the note under Article 3 of the 2017 Law on Strengthening and Developing the Standard System, goods on the joint list maintained by the National Standards Organization and the Food and Drug Organization may be cleared without review by the standards office, based solely on the Food and Drug Organization’s authorization. This followed from the finding that health, treatment and pharmaceutical services fall outside the scope of the standards provision, with oversight authority and policy-setting for such matters resting with the Ministry of Health.

To prevent accumulation and disruption in the import of health-related items, customs offices nationwide were instructed to implement clearance of goods related to this list based solely on Food and Drug Organization confirmation, without standards-office review, within the Comprehensive Trade System (Samaneh Jame’-e Tejarat).
