The Ministry of Industry, Mine and Trade has notified the Islamic Republic of Iran Customs Administration that the export ban on backgammon boards, classified under tariff code 95049090, has been lifted.
The matter originated from a request by the Ministry of Cultural Heritage, Tourism and Handicrafts, whose Deputy for Handicrafts and Traditional Arts asked the Trade Promotion Organization of Iran to review and resolve the export prohibition affecting backgammon boards. The request was referred to the Ministry of Industry, Mine and Trade’s Legal and Parliamentary Affairs Deputy for a legal opinion.
That review concluded that, under clause (f) of Article 1 of the Customs Affairs Law, a “prohibited good” is one whose export or import is banned by law based on national interests or the sacred principles of Islam, meaning prohibition requires explicit legislation by the Islamic Consultative Assembly (Parliament). While Note 2 of Article 1 of the Export and Import Regulations Law allows the government to temporarily restrict the export or import of certain goods under special circumstances, the Anti-Smuggling of Goods and Currency Law defines prohibited goods strictly as those banned by law, and its supplementary note clarifies that government or other authorities’ restrictions issued under statutory authority render goods “restricted,” not “prohibited.” Because backgammon boards had not been explicitly prohibited by Parliament, and because Article 3, clause (a) of the Permanent Provisions of Development Plans Law establishes a general presumption in favor of allowing the export of all goods, the legal opinion concluded that no impediment exists to the export of backgammon boards.
Based on this determination, the Export and Import Regulations Office of the Trade Promotion Organization of Iran instructed Iran Customs that export of the goods under tariff code 95049090 is permitted, subject to compliance with other applicable regulations and standards, and asked that customs offices be notified accordingly.
