Petrochemical Export Restriction Circular Repealed

Iran's Trade Promotion Organization has repealed circular No. 332901/60 of December 2020, which had restricted the export of petrochemical products to producing units and their legal representatives, citing the absence of a legal basis for continuing the restriction.

The Ministry of Industry, Mine and Trade, through the Trade Promotion Organization’s Export and Import Regulations Office, has notified Iran Customs that circular No. 332901/60, dated December 21, 2020, which restricted the export of petrochemical products under specified tariff lines to producing units and their legal representatives, is repealed.

The restriction had originally been applied under clause (b) of Article 9 of the Market Regulation Instructions for Petrochemical Products pursuant to authority delegated to the Market Regulation Task Force by the Supreme Council for Economic Coordination of the Heads of the Three Branches. Correspondence from the Secretary of the Supreme Council for Economic Coordination clarified that, because the extension of authority delegated to the Market Regulation Task Force did not cover export restrictions on goods outside the Task Force’s mandate under Article 23 of the Law on Permanent Provisions of the Country’s Development Programs, no legal basis existed to continue applying the restriction on petrochemical product exports for the purpose of domestic market regulation. In 1404 (the current Iranian year) and prior to it, the only documented basis for the limitation had been the December 2020 circular itself.

Following review by the relevant deputy and specialized office, the Trade Promotion Organization concluded that, absent a legal basis to continue enforcing clause (b) of Article 9 of the Market Regulation Instructions (the subject of the December 2020 circular), the circular is repealed. The notice clarifies that this repeal does not affect other applicable rules, and that separate correspondence on export possibilities for non-producing units under similar tariff classifications (e.g., carbon black and other forms of carbon not elsewhere specified under tariff code 2803.0000 by industrial carbon black and carbon fumee companies, and polyethylene wax under tariff code 3404.9000 by certain companies) remains subject to review under existing regulations and prior correspondence.

Exporters of petrochemical products should note that the requirement limiting exports under the relevant tariff codes to producing units or their legal representatives no longer applies, though all other applicable export rules and standards continue to apply.
