Iran’s Trade Development Organization has instructed that Article 45 of the National Economic and Non-Military Defense Resilience Package, known as Shoam, be applied within the Comprehensive Trade System.

The instruction follows the minutes of a Foreign Exchange Committee meeting and the provisions of clause 45 of the Shoam resilience package, approved under a resolution of the Supreme Council of Economic Coordination among the heads of the three branches of government. Under the directive, a new line item titled “Clause 45 of the Shoam Resilience Package: Goods Releasable Upon Submission of a Commitment Letter Based on Non-Receipt of Foreign Currency from the Central Bank” is to be added beneath clause 9 of Article 38 in the relevant regulatory schedule.

The purpose of this addition is limited to allowing existing order registrations to be edited so that they can be routed to Customs on the basis of non-receipt of foreign currency from the Central Bank. This editing capability is available only through the date specified in the directive. Order registrations issued under this line item may not have their tariff code edited, and the quantity of goods may not be increased beyond what was originally registered.

The notice further specifies that this provision does not require obtaining a permit involving currency transfer from the Ministry of Industry, Mine and Trade’s specialized offices, and that goods processed under this clause must not be subjected again to bank-based foreign exchange operations.
