Iran’s Ministry of Industry, Mine and Trade, through the Trade Development Organization’s Export and Import Regulations Office, has responded to Iran Customs regarding cases in which statistical registration for imports is issued based on the currency proceeds of export licenses whose one-year deadline under Note 5 of Article 6 of the Executive Bylaw of the Border Trade Organization Law has already expired.
The matter was raised in correspondence from Bushehr Customs, which reported instances involving border-resident cooperative companies where import declarations relied on statistical registrations whose underlying export licenses were used as the source of currency, but where the one-year deadline for the export license had already lapsed at the time of import. In one case cited, an import declaration used a statistical registration linked to an export license dated in the Iranian calendar year 1402 whose one-year validity period had ended before the corresponding import was declared. The customs office also noted a discrepancy in currency conversion rates, since import and export declarations are denominated in US dollars while the currency-source deduction on the export license was calculated in euros, causing values not to reconcile after conversion, and it asked for guidance on how to treat the currency-source deduction and the reuse of previously deducted licenses in subsequent currency-source declarations.
In response, the Ministry stated that statistical registration and receipt of the currency-source designation from Note 5 of Article 6 of the bylaw is permitted for import, subject to compliance with other applicable rules and regulations, only where the goods declaration is made within the one-year deadline running from the export license date. Where that one-year deadline has already expired at the time of import, the Ministry instructed that the relevant executive customs offices be notified accordingly.
Customs offices and border-resident cooperative companies relying on export-proceeds-based statistical registration for imports should verify that the underlying export license remains within its one-year validity window at the time the import declaration is made, since registrations based on licenses past that deadline are not permitted under this clarification.
